Acceptance of Terms
By downloading, installing, or using the HotSpot mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Description of Service
HotSpot is an AI-powered restaurant reservation service that helps users discover and book tables at restaurants worldwide. Our AI concierge attempts to secure reservations on your behalf through various communication channels including phone calls, messages, emails, and booking portals.
User Accounts
To use HotSpot, you must create an account. You agree to:
- Provide accurate and complete information when creating your account
- Keep your account credentials secure and confidential
- Be responsible for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
Credits and Payments
HotSpot operates on a credit-based system:
- 1 credit equals 1 person per booking (e.g., a party of 4 uses 4 credits)
- Credits are consumed only when a reservation is successfully confirmed
- If we cannot secure your reservation after multiple attempts, credits are refunded to your account
- Credits do not expire and are non-transferable
Reservation Service
Regarding our reservation service:
- We make best efforts to secure reservations but cannot guarantee availability
- Restaurant availability is subject to the restaurant's policies and capacity
- Once confirmed, reservations are subject to the restaurant's terms and cancellation policies
- You are responsible for honoring confirmed reservations or canceling according to restaurant policies
User Conduct
You agree not to:
- Use the service only for lawful purposes
- Make fraudulent or abusive reservation requests
- Attempt to interfere with or disrupt the service
- Misuse the AI concierge system or attempt to manipulate results
Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are owned by HotSpot and are protected by international copyright, trademark, and other intellectual property laws.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. RESTAURANT INFORMATION MAY NOT ALWAYS BE ACCURATE OR UP-TO-DATE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOTSPOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO MISSED RESERVATIONS OR DINING EXPERIENCES.
Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease.
Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
